General terms and conditions

These general terms and conditions apply to all customers. Customers acknowledge, by accepting the general terms and conditions below, to have sufficient command of the Dutch language to fully understand their content and scope.

Article 1 - PREVIOUS DEFINITIONS

Products and services: all products and services offered by the company Adriaensen Specialty Store Games on its website, in particular the sale of board games and accessories via the website(s)http(s)://adriaensen-speciaalzaak.be,http(s)://time2game.be,http(s)://crokinole.be.

User: every person who has registered on the website of Adriaensen Specialty Store Games.

Customer: every registered user who places an order with Adriaensen Speciaalzaak Gezelschapsspel via the website of Adriaensen Speciaalzaak Gezelschapsspel. A Customer is deemed to have the legal capacity to make such a purchase on the Adriaensen Games Specialty Shop website.

Supplier: any supplier of games from which Adriaensen Games Store offers games for sale on its website.

Order: any order placed by a customer, either via the shopping cart or via email.

Article 2 - SCOPE OF APPLICATION

These general terms and conditions apply to every order placed with Adriaensen Specialty Store Games by a user of the website, through which a distance sale takes place. The underlying general conditions only outline the framework for the commercial relations that could arise between a user/customer and Adriaensen Specialty Shop Games.

Article 3- ACCEPTANCE BY THE USER/CLUSTOMER

Registration as a user on the website(s)http(s)://adriaensen-speciaalzaak.be,http(s)://time2game.be,http(s)://crokinole.beas well as placing an online order with this games shop, implies that the user or customer has unconditionally and irrevocably accepted the underlying general terms and conditions.

Article 4 - SELLER'S CONTACT DATA

Adriaensen Specialezaak Gezelschapsspellen is a trade name of Mr Carl Adriaensen, trading under Belgian law and based at 2018 Antwerp, Cuperusstraat 7 (Belgium). The trader is registered in the Crossroads Bank for Enterprises in Belgium under company number 0849.323.486 and with intra-community VAT number BE0849323486. Telephone +32 (0)3 239 25 25.

Article 5 - CUSTOMER REGISTRATION DATA

Any person can become a registered user of the Adriaensen Specialty Store Games website by registering on the Adriaensen Specialty Store Games website. This registration is necessary to place an order according to article 6 of the present terms and conditions.

Article 6 - ORDERS

The products and services, as defined in article 1, are offered for sale via the websitehttp(s)://adriaensen-speciaalzaak.be,http(s)://time2game.be,http(s)://crokinole.be. The customer accepts that only the data registered in the computer system of Adriaensen Specialty Nursery as well as through the applicable payment system are proof of the communication as well as of the content of the order and the whole of the transactions that have taken place between the parties. The customer will receive a confirmation of his/her order via email after the purchase, and a second email at the moment the order is shipped by Adriaensen Games Specialty Shop. All contractual information regarding the order is communicated to the user in the Dutch language.

Article 7 - PRICES AND PAYMENT METHODS

The prices stated during the purchase process are in Euro, including VAT and administrative costs, unless otherwise explicitly indicated. The prices of the products and services do not include the cost of shipping. Shipping costs are listed separately on the website under the heading 'orders and deliveries' and are charged additionally. The VAT rate applicable is the VAT rate valid in the country where the delivery address is located, being Belgium or the Netherlands. Adriaensen Specialty Store Games reserves the right to change the sales prices at any time. However, purchased products and services will always be invoiced at the prices mentioned in the e-mail confirming the order. Indeed, these are the prices applicable at the time of purchase. The products remain the property of Adriaensen Games Specialty Shop until they have been fully paid by the customer.

Adriaensen Gameshop reserves the right to refuse any order from a customer with whom a dispute is pending or has arisen in the past. Purchases can only be paid online by Bancontact, iDEAL, Maestro, MasterCard or Visa. With the exception of bank transfer, the customer's bank account will be debited after confirmation of the purchase, and the payment will only become effective when the customer's bank has given its approval to Adriaensen Specialty Store Parlour Games. In the event that the customer's bank refuses payment, the order is automatically refused. Customers guarantee that they are legitimate to make online payments using one of the payment methods listed above and that there is sufficient cover in the bank account associated with the bancontact card, or iDEAL account, to cover all costs arising from the transaction. For the handling of the online payment, Adriaensen Specialty Store Games works with CCV. Adriaensen Speciaalzaak Gezelschapsspellen does not have access to the confidential payment information of its customers. These are therefore not stored by Adriaensen Specialty Store Games. This is the reason why the customer's payment data must be requested again with each purchase. The confidential payment data (bank cards, due dates, security codes) are only accessible to the CCV company. In case of payment by bank transfer, the payment will only be effective when the funds have actually been received on the bank account of Adriaensen Games Specialists. Article 8 - AVAILABILITY

The products and services, as well as the prices, are valid as they are displayed on the Adriaensen Games Specialty Shop website, within the limits of the availability of these products and services from the supplier. Adriaensen Games Specialty Shop undertakes to use its best efforts to deliver all orders. Nevertheless Adriaensen Specialty Game Shop cannot be held responsible for the unavailability (anymore) of a product or service from the supplier, nor for the damage that could result. In the event that one or more products or services of an order would be unavailable, the customer will be informed by e-mail or by telephone that his/her order will be cancelled entirely or partially. In case the unavailability is established and communicated at the moment the customer has already paid for his/her products, Adriaensen Specialty Parlour will immediately request its bank to refund the paid amounts. The customer will be informed of this via e-mail. the speed of the effective refund then depends on the payment method the customer has used to make his/her purchase. If the customer feels that the refund is taking an abnormally long time, it is recommended that the customer contacts his/her bank.

Article 9 - DELIVERY

Orders are delivered to the delivery address as provided by the customer during the ordering process and according to the conditions described there. Adriaensen Specialty Store Games reserves the right to split the order into one or more deliveries in function of the availability of the products. Each delivery is announced by e-mail. The delivery is accompanied by a delivery receipt, which also gives details of the goods delivered. The delivery is presented to the customer or to any other person present at the delivery address who has power of attorney to accept the package. If no one can take delivery of the parcel at the time it is presented, a message will be left in the letterbox by the carrier indicating the name and contact details of the carrier. The customer must then contact the carrier himself to find out where and when the parcel can be picked up by the customer. Adriaensen Specialty gift shop ensures that the order is processed in the shortest possible time. The delivery period that may be mentioned on the website and/or by e-mail after the purchase has been made via the Internet is a purely indicative period and is in no way binding for Adriaensen Games Specialists. The latter can in no case be held responsible for any delay in the delivery of the products or services, nor for any damage that could result from this. Adriaensen Specialty gift shop undertakes that the delivery will be sent at the latest 2 months after the order date. The control system used by the carrier serves as proof of the effective dispatch, respectively delivery of the order (and of its good receipt by the customer), except for written evidence to the contrary from the customer. In the event that a customer proves that a delivery was not sent within 2 months after the order date by Adriaensen Specialty Store Companion Games, the customer can cancel the order without any damage, provided that he/she informs Adriaensen Specialty Store Companion Games that he/she wishes to cancel his/her order by registered letter, with acknowledgment of receipt, sent to the address mentioned in article 3 of the underlying general terms and conditions.

Article 10 - CONFORMITY

The products purchased comply with the subjective conformity requirements set out in the purchase agreement, as applicable, in particular:

- In terms of description, type, quantity and quality, functionality, compatibility, interoperability and other characteristics, they comply with the purchase agreement;

- They are suitable for any particular use desired by the consumer, which the consumer has communicated to Adriaensen Specialty Store Games no later than at the conclusion of the purchase agreement and which Adriaensen Specialty Store Games has accepted;

- They are delivered together with all accessories and instructions, including installation instructions, as stipulated in the purchase agreement; and

- They are provided with updates as stipulated in the purchase agreement.

In addition, the products purchased meet the objective conformity requirements required by Article 1649ter, §3 Old Civil Code. 

Adriaensen Specialty Game Shop is liable to the consumer for any conformity defect that exists at the time of delivery of the consumer goods and that manifests itself within a period of two years from the aforementioned delivery.

 

Article 11 - COMPLAINTS

If the consumer is not satisfied with the way his order has been handled, he/she can, within ten working days after receipt of the product, make this known to Adriaensen Specialty Store Parlour Games via written communication or an e-mail addressed to info@adriaensen-speciaalzaak.be. Expressing a complaint, however, does not release the buyer from his payment obligation.

Article 12 - APPLICABLE LAW

All purchases are subject to Belgian law. For all disputes arising from orders and purchases via this website, the Courts of Antwerp, Antwerp Division, are competent.
